YOUR DETAILS The following terms and conditions apply when you register your details on any area of our website. You must provide us with true and correct information. You must keep your user name and password confidential. If you access our web from a public computer and do not sign out, someone else who uses that computer after you may be able to access that account. We recommend that all devices that are used have password protection. If you feel someone has accessed your account we recommend changing your details.
TERMS OF SALE Terms of Sale of goods between the parties is identified when an order is placed through the website. The purchaser is subject to specific Terms and Conditions. All orders are subject to availability and confirmation. Our dispatch times may vary according to availability and any guarantees with respect to delivery times are subject to the Terms and Conditions of the Carrier.
OUR CONTRACT OF SALE When your order is placed you will receive an order confirmation. Only when payment has been made and accepted by us. Without payment approval the goods remain the property of Macquarie Medi Spa.
PAYMENT METHODS Payment methods available to you are listed on our website. We reserve the right to vary these payment methods from time to time at our discretion. No orders will be dispatched until payment in full has been received, approved and processed by Macquarie Medi Spa.
PRICING AND AVAILABILITY Whilst we try to ensure that all details, descriptions and prices that appear on our website are true, correct and accurate, from time to time errors may occur If we discover an error in the price of goods that you have ordered we will inform you as soon as possible, providing you with the option of reconfirming your order at the correct price or the opportunity of cancelling it. If we do not hear back from you we will cancel the order without further notice. If the goods have been paid for you will receive a full refund. Delivery costs are an additional charge which are clearly displayed and included in “total cost”.
DISCOUNT CODES From time to time we will offer promotional discount codes. These codes will only be applied to the specific products to which the discount code relates. Conditions exist surrounding the use of all discount codes with specific details provided at the time of issue. All discount codes are available to customers on a one time only basis based on name, address, e-mail address.
INCORRECT ORDERS If the item received is not the product to which the purchaser ordered or which is stated and paid for under the agreement or contract of sale, as listed on the invoice, these products may be returned, however any use of the products by the purchaser will be deemed as acceptance by the purchaser and will not be replaced by Macquarie Medi Spa. If in the event that you do receive goods incorrectly, please contact us and you will not be charged for a redelivery, if it is agreed that Macquarie Medi Spa is at fault. All products to be returned must satisfy the following criteria: The same/actual product to which was received by the purchaser, which was the incorrect product to which was ordered, not a substituted product i.e. old stock, stock belonging to another similar or same type product. Any returns that do not satisfy the above mentioned will see the purchaser charged the full price of the product as well as freight costs.
UNWANTED ORDERS If the item received by you is not what you wanted (excluding incorrect orders - see incorrect order insert) those products shall be deemed accepted and remain the property of you. Macquarie Medi Spa will not accept any return of these items under any circumstances
RETURNING GOODS IF THEY ARE FAULTY You may be entitled to a replacement and or you may entitled to have the goods repaired or replaced if the goods fail to be of an acceptable quality. This must be done with in 7 days of receipt of the product. If you believe that there is a fault with the goods you have received, please let us know. Please include as many details about the order and the problem with the goods. Upon receipt of of the goods returned they will be inspected and if the item is deemed to be faulty, we will replace the product free of additional freight charge.
RETURNS You are responsible for the costs of returning the goods to us. Any goods returned to us are your responsibility until they reach our warehouse. Please ensure you pack the goods sufficiently to prevent any damage to the goods. We recommend you use the postal service and obtain tracking information. Please contact us for a returns address.
PRODUCT DISCLAIMER All express or implied guarantees, warranties, representations or other terms and conditions relating to these Terms of Service or their subject matter, not contained in these Terms of Service to the maximum extent permitted by law. Nothing in these Terms of Service excludes, restricts or modifies any right or remedy, any guarantee, warranty or other term or condition, implied or imposed by any legislation which cannot be lawfully be excluded or limited. This may include the Australian Consumer Law which contains guarantees that protect the purchasers of goods and services in certain circumstances. If any guarantee, warranty, term or condition is implied or imposed in relation to these Terms of Service under the Australian Consumer Law or any other applicable legislation and cannot be excluded (a “non excludable provision”) and Macquarie Medi Spa is able to limit the remedy for a breach of non-excludable provision then the liability of Macquarie Medi Spa for breach of the non-excludable provision is limited to one or more of the following options; in the case of goods; the replacement of the goods or the supply of equivalent goods, subject to Macquarie Medi Spa obligations under Non-Excludable provisions and to the maximum extent permitted by the Law, Macquarie Medi Spa is not liable for and no measure of damages will under any circumstances will include special; indirect, consequential, incidental or punitive damages or damages for loss of profits, revenue, goodwill, anticipated saving or loss or corruption of data, whether in contract tort (including negligence), in equity, under statute, under indemnity based on breach or fundamental breach or any other basis, whether or not such loss or damage was forseable and even if advised of the possibility of the loss or damage.
Failure to notify us with 24 hours notice of a cancellation will incur a 50% of your treatment cancellation fee
Failure to show or give notice for gift vouchers will result in your gift voucher being marked as redeemed
INDEMNITY You agree to indemnify, defend and hold harmless Macquarie Medi Spa its directors, officers, employees, agents and affiliates from any and all third party claims, liability, damages and or costs (including but not limited to legal fees) arising from your use of this website.
VARIATION Macquarie Medi Spa shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the services and or any page of this website.
COMPLAINTS Please let us know if you have any complaints or comments as we have a complaint procedure, where we will endeavour to handle disputes as they may arise.
WAIVER If you breach the conditions set out and we take no action, we will still be entitled to use our rights and remedies in any other situation where the conditions are breached. Any waiver of any provision of these Terms of Service will be effective only if in writing and signed by a Director of Macquarie Medi Spa.
AGREEMENT ENTIRITY The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Macquarie Medi Spa.
ETHICAL SOURCING POLICY Macquarie Medi Spa is a reputable and trusted business that is committed to offering our customers high quality goods. Macquarie Medi Spa recognises its obligations to ensure that our suppliers are operating ethically. Our expectation is such that our suppliers consistently provide an environment which protects their employees health and safety and basic human rights. All of our suppliers are expected to comply with their National employment laws and regulations with regard to age requirements, health and safety, no discrimination, no in humane treatment, working hours, fair pay and employment terms. We do not test any of our products on animals and ensure our suppliers do the same.
